1 PHI 108 PROFESSIONAL ETHICS ARISTOTELIAN VIRTUE THEORY PA (… AND RIGHTS THEORY AGAIN) (UNIT 4 PA) Analyze and resolve the case study titled “Case 2: The Nurse and the Sixteen -Year -Old Patient ” on page 52 of MPL. Pretend you are the nurse . “Sixteen -Year -Old ” has been struck of the title because we are going to change one of the fundamental facts of the case. Pretend that the young person asking for birth control pills is 18 years old instead of 16 yea rs old. That changes the case dramatically , but also makes it more interesting. Here are facts that you should add to the description of the case provided in MPL: 1. The young woman talking to the nurse is 18 years old, not 16 years old. 2. The young woman still lives at home with her parents and younger siblings. 3. The young woman’s whole family — including her mother, father and siblings — have been coming to see “the doctor” in th is case study for many years. 4. The nurse h as been working with “the doctor” for a long time and knows the young woman, the mother, and the rest of the family quite well. 5. The doctor (the owner of the medical practice) trusts the nurse, and the unspoken practice has been for the nurse to do whatever she can to help him. The doctor expects the nurse to help him obtain relevant medical information from patients, and to disseminate relevant medical information to patients. 6. Beth does not realize that her mother reviews the family’s monthly health insurance statements, including Beth’s statement, on a regular basis. So if Beth tries to use her health insurance to pay for birth control pills, her mother will almost certainly find out. (As an experienced nurse, you should expect that Beth does not know these facts .) 2 Complete the f ollowing parts of the CRM form in order to analyze and resolve the case: Part III When constructing options in Part III, be creative. Above all be sure to include a n option that you think a virtue theorist would like. You will need an option that a virtue theorist would like to select for Part VII (a). Also include an option that you think a rights theorist would like. Part V You decide whether to think like a natural rights theorist or a contract rights theorist when doing Part V. Keep in mind that most rights theorists — both natural rights theorists and contract rights theorists — would probably agree about both the fundament al and non -fundamental rights at stake in the case. Also keep in mind that theorists of both stripes might also agree about what to do. Where the two types of theorists will differ is in which rights they give the most weight and how they talk about the case. When doing Part V, add a section where you clearly state whether you are thinking about the case more like a natural rights theorist or a contract rights theorist. In this same section answer, and explain your answer to the following questions: 1) Why is my thinking more like that of a contract right theorist than a natural rights theorist? (Or “Why is my thinking more like a natural rights theorist than a contract rights theorist?”) 2) Would a natural rights theorist pick the same option? (Or “Wo uld a contract rights theorist pick the same option?”) 3 Part VI Since this is primarily an exercise in applying virtue theory, you should put most of your efforts into completing this section. For some reason, modern American students are not very good at identifying virtues and vices. Be sure to give the common names for the virtues and vi ces you think are involved (for example, “caring” or “irresponsible”). Keep in mind that not all virtues and vices have common names (Aristotle noted that this was also true of ancient Greek). When a virtue or vice lacks a common name, create a name for it . (That’s what Aristotle did !) Often you can create a name for a virtue or vice by constructing a phrase beginning with “being” — for example , “being respe ctful,” or “being disrespectful.” Part VIII When doing Part VIII, make sure that your selection in Part VIII (a), your discussion of which values influenced your choice, and your discussion of which theory(s) influenced your choice is consistent with th e rest of your analysis.
